Terms and Conditions for Removals Man and Van Services
Welcome to our Removals Man and Van service. These Terms and Conditions govern your use of our services and outline the responsibilities and obligations of both the service provider and the client. By engaging our services, you agree to comply with and be bound by these terms.
1. Definitions
For the purposes of these Terms and Conditions:
- Client: The individual or entity requesting removal services.
- Service Provider: The Removals Man and Van company offering the services.
- Goods: All items, equipment, or property to be moved or transported.
- Service: The execution of removal tasks as specified in the service agreement.
2. Service Booking and Confirmation
To book our services, the Client must provide accurate and complete information regarding the move, including but not limited to the date, time, locations, and nature of the goods to be moved. Upon receipt of this information, the Service Provider will confirm the booking subject to availability.
2.1. Reservation
Reservations are secured upon receipt of a deposit as specified in the booking confirmation. The remaining balance is due upon completion of the service unless otherwise agreed upon.
2.2. Changes and Cancellations
The Client may request changes or cancellations to the booking. Such requests must be made in writing. Cancellation fees may apply depending on the timing and nature of the request.
3. Pricing and Payment
All prices are quoted based on the information provided at the time of booking. Any additional services or changes requested by the Client may result in additional charges.
3.1. Payment Terms
Payments can be made via cash, credit card, or bank transfer. Invoices will be issued upon completion of the service, and payment is due within 14 days unless otherwise specified.
3.2. Deposit
A deposit is required to secure the booking. This deposit is non-refundable unless the Service Provider cancels the booking.
4. Client Responsibilities
The Client agrees to:
- Provide accurate information regarding the nature and volume of goods to be moved.
- Ensure that all items are ready for removal at the agreed-upon time.
- Provide clear access to the premises for the Service Provider.
- Ensure that the property is secured and that all valuables are accounted for.
5. Service Provider Responsibilities
The Service Provider agrees to:
- Provide professional removal services as described in the service agreement.
- Handle all goods with care to prevent damage during the removal process.
- Arrive at the agreed-upon time and complete the service within the estimated timeframe.
- Ensure that drivers and personnel are appropriately trained and qualified.
6. Liability
The Service Provider is liable for any damage to the Client’s goods resulting from negligence or improper handling by the Service Provider’s personnel. However, the Service Provider is not liable for:
- Damage caused by the Client’s negligence.
- Items not properly packed or secured by the Client.
- Valuables, sensitive documents, or irreplaceable items unless specifically agreed upon.
- Delays caused by circumstances beyond the Service Provider’s control, such as extreme weather or traffic conditions.
6.1. Insurance
While the Service Provider carries standard liability insurance, the Client is encouraged to obtain additional insurance coverage for high-value items or for peace of mind.
7. Damage and Claims
In the event of damage to goods during the removal process, the Client must:
- Inspect goods immediately upon delivery.
- Report any damage to the Service Provider within 24 hours of delivery.
- Provide detailed information and, if possible, photographic evidence of the damage.
All claims will be assessed in accordance with the Service Provider’s insurance policy.
8. Scheduling and Timelines
The Service Provider will make every effort to adhere to the scheduled time frame. However, the Client acknowledges that unforeseen circumstances may cause delays. The Service Provider will communicate promptly regarding any changes.
9. Access to Property
The Client must ensure that all necessary permissions and access rights are granted to the Service Provider for the removal process. This includes securing parking permits or access codes if required.
9.1. Building Regulations
If the removal involves multi-story buildings or properties with restricted access, the Client is responsible for informing the Service Provider in advance to facilitate a smooth process.
10. Prohibited Items
The following items are not eligible for removal through our services:
- Hazardous materials such as chemicals, asbestos, or flammable substances.
- Perishable goods like food items exceeding a certain age.
- Pets and live animals.
- Firearms and ammunition unless legally permitted and declared.
- Items of illegal nature or those that infringe on copyright laws.
11. Force Majeure
The Service Provider is not liable for failure to perform any obligation under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, war, strikes, or government regulations.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which the Service Provider operates. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in that area.
13. Amendments to Terms
The Service Provider reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of the services indicates acceptance of the revised terms.
14. Privacy Policy
The Service Provider is committed to protecting the privacy of its clients. Personal information collected during the booking and service process will be used solely for the purpose of providing the requested services and will not be shared with third parties without consent, unless required by law.
14.1. Data Protection
All client data will be stored securely and in compliance with applicable data protection regulations. Clients have the right to access, correct, or request deletion of their personal information.
15. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
16. Entire Agreement
These Terms and Conditions constitute the entire agreement between the Client and the Service Provider concerning the subject matter herein and supersede all prior agreements, understandings, and representations.
17. Acceptance of Terms
By engaging our removals services, the Client acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
18. Additional Provisions
18.1. Indemnification
The Client agrees to indemnify and hold harmless the Service Provider from any claims, damages, or expenses arising out of the Client’s misuse of the services or violation of these Terms.
18.2. Subcontractors
The Service Provider may engage subcontractors to perform certain tasks. The Service Provider remains responsible for the actions of any subcontractors.
18.3. Communication
All communications between the Client and the Service Provider should be conducted through the agreed-upon channels to ensure clarity and record-keeping.
